Timothy Doherty: U.S. Attorneys can help build a more equitable criminal justice system

Editor’s note: This commentary is by Timothy C. Doherty Jr., of Burlington, who served for 10 years as an Assistant U.S. Attorney in the District of Vermont.  He is currently a director at the law firm of Downs Rachlin Martin, where he focuses on criminal defense and complex civil litigation.

On May 25, 2020, police in Minneapolis killed George Floyd while arresting him for allegedly using counterfeit money. People across the country reacted to Floyd’s death with anguish. In some of the largest demonstrations this country has seen since the 1960s, citizens took to the streets and demanded that the long-festering problem of racial bias in the criminal justice system be addressed.

Prosecutors play a special role in our justice system. A prosecutor represents the community, not a specific person or organization. It is therefore the responsibility of every prosecutor to ensure that the criminal justice system treats the entire

Attorneys noticing more divorce filings caused by pandemic

The pandemic has put a strain on everyone this year, and for some staying home, financial trouble or losing work has put a strain on relationships.

Some lawyers say they’re seeing more divorce filing this year because of it.

“I have been doing family law for about 25 years,” said Debbie Self, a partner at Self Morey & Associates. “I would tell you that we have had an unusual surge in divorces both last year in the late fall and again this year in the late fall.”

Family attorney Debbie Self says there’s usually a lull in filings around the holidays.

She says some people wait until they’re over, and others might wait to get their tax returns in the spring to file for divorce.

“The one thing that I’ve heard probably more consistently than anything is that a person might have been in a marriage that they were willing

Model rule revision allows attorneys to help pro bono clients in need

Ethics

Daniel Greenberg became interested in amending ABA Model Rule 1.8(e) when he realized he’d been in violation of it his entire career.

“It literally did not occur to me that it could be unethical to, when you were in court waiting for a case to be heard, take an indigent client to lunch with her kids or give her carfare to get home or, in some cases, help her with food and some necessities,” says Greenberg, the special counsel for pro bono initiatives at Schulte Roth & Zabel in New York City.

“And when I found out that one wasn’t supposed to do it, it was almost like I laughed out loud. It felt so bizarre to me, that of all things, we couldn’t do this as an ethical

D.C.’s Karl Racine to the lead the National Association of Attorneys General and take on hate and extremism

In the past five years, he has gone after price gougers and corrupt landlords, opened an investigation into sexual abuse by Roman Catholic clergy in D.C. and repeatedly taken on President Trump, bolstering the city’s national profile in the process.

And next week, he will assume the presidency of the National Association of Attorneys General (NAAG), a nonpartisan coalition representing every U.S. state and six territories. Using his new platform, Racine, a Democrat, will ask his fellow attorneys general to set aside political differences to combat hate crimes and extremism across the United States.

Each NAAG president, elected as part of a regional rotation, gets to choose a focus for the year-long term; previous efforts have included elder abuse and human trafficking. Racine is the first to take on hate crimes. Attorneys general from both parties have praised the initiative as timely, albeit sensitive, amid national conversations about racial justice
